Terms of Service

These Terms of Service ("Terms") govern your use of the services provided by Sovereign Data Defence ("we", "us", "our"). By engaging our services, you ("the Client") agree to be bound by these Terms.
1. Definitions
- "Service" refers to the on-site data erasure, physical destruction, IT asset management, and related services provided by us.
- "Assets" refers to the computer hard drives, solid-state drives, servers, PCs, laptops, and any other data-bearing hardware provided by the Client for the Service.
- "Certificate of Destruction" refers to the official document we provide upon completion, certifying the successful sanitisation of the specified Assets.
2. Service Engagement and Quotations
All services will be performed in accordance with a formal quotation or Statement of Work approved by the Client. A service booking is confirmed only upon our acceptance of the Client's request and agreement on the scope and pricing. Estimates provided on our website are indicative and not binding until a formal quotation is issued and accepted.
3. Client Obligations
The Client warrants and agrees to:
- Provide accurate information regarding the quantity and type of Assets to be serviced.
- Ensure that they have the legal right and authority to commission the destruction of the data on the Assets.
- Provide a safe and accessible work environment for our personnel and equipment at the specified on-site location.
- Provide access to a stable power supply as required for our equipment to function.
- Ensure all Assets are free from biological hazards or other contaminants.
4. Service Performance
We agree to perform the Service with due care and skill, in accordance with professional industry standards. Our commitment includes:
- Performing data erasure to the standard specified in the service agreement (e.g., DoD 5220.22-M).
- Providing a Certificate of Destruction detailing all processed Assets by serial number where practicable.
- Physically destroying on-site any Asset that fails to complete the software erasure process, to ensure a complete chain of custody.
5. Payment Terms
Payment terms will be specified on our invoice. Our standard term is fourteen (14) days from the date of the invoice, unless otherwise agreed in writing. We reserve the right to withhold the Certificate of Destruction until full payment has been received.
6. Limitation of Liability
The Client acknowledges that the express purpose of the Service is the complete and irreversible destruction of data. We shall not be liable for any loss of data or information, as this is the intended outcome of the Service.
To the maximum extent permitted by law, our total liability for any claim arising out of or in connection with the Service, whether in contract, tort (including negligence), or otherwise, is limited to the total fees paid by the Client for the specific Service giving rise to the claim.
We are not liable for any indirect, consequential, or special loss, including loss of profit or business interruption.
7. Confidentiality
We will treat all information we receive from the Client in the course of providing the Service as confidential. We will not disclose any confidential information to any third party, except as required to perform the Service or as required by law.
8. Intellectual Property
All content on our website (sovereigndatadefence.com), including text, graphics, logos, and software, is our property or the property of our licensors and is protected by copyright laws.
9. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Western Australia. Both parties agree to submit to the exclusive jurisdiction of the courts of Western Australia to resolve any disputes.
10. Changes to These Terms
We reserve the right to modify these Terms at any time. The version of the Terms that will apply to your engagement is the version that is current at the time you accept our quotation.
